These Terms of Service ("Terms") govern your use of the services provided by BLUPEAK MEDIA LLC ("BLUPEAK MEDIA," "we," "our," or "us"), including our website at blupeakmedia.com, any landing page we operate on behalf of a client, and any SMS, email, or telephone communication you receive from us. By accessing our services, submitting an inquiry through a page we operate, or communicating with us, you agree to be bound by these Terms.
BLUPEAK MEDIA LLC is a marketing agency serving residential roofing contractors. Our services consist of building and hosting landing pages on a contractor's own domain, running advertising campaigns on the contractor's behalf, receiving and managing consumer inquiries generated by that advertising, and communicating with those consumers to schedule roof inspections and estimates on the contractor's behalf. We reserve the right to modify or discontinue our services at any time.
When you submit an inquiry on a landing page we operate, you are requesting service from the roofing contractor identified on that page. BLUPEAK MEDIA acts as that contractor's service provider and communicates with you on the contractor's behalf.
The roofing contractor, not BLUPEAK MEDIA, is solely responsible for the roofing services themselves, including inspections, estimates, pricing, scheduling commitments, materials, workmanship, warranties, licensing, insurance, and any agreement you enter into for roofing work. BLUPEAK MEDIA is not a roofing contractor, does not perform roofing work, does not inspect roofs, and does not set prices or provide estimates. Any contract for roofing services is between you and the contractor.
BLUPEAK MEDIA makes no representation or warranty regarding the quality, timeliness, pricing, or outcome of any roofing work performed by a contractor.
Submitting an inquiry does not create an obligation for any contractor to provide an estimate or perform work, and does not guarantee that any particular appointment time will be available. Any statement in an advertisement or message regarding potential savings, timing, or availability is an indication only and is not a binding offer or a guarantee of any specific result.
You agree to use our services in compliance with all applicable laws and regulations. You must not use the services for any unlawful purpose, submit false or fraudulent information, submit another person's contact information without their permission, or interfere with or disrupt the services or the servers and networks connected to them.
We own all rights, title, and interest in and to our services and materials, including all intellectual property rights, except for client trademarks and content which remain the property of the respective client. You are granted no license other than to view and use the pages for their intended purpose.
Your use of our services is also governed by our Privacy Policy, available at https://blupeakmedia.com/privacy-policy, which is incorporated by reference into these Terms.
To the maximum extent permitted by law, BLUPEAK MEDIA LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use or inability to use the services, any roofing services performed or not performed by a contractor, any unauthorized access to our servers or personal information stored therein, or any interruption or cessation of transmission to or from the services.
You agree to indemnify, defend, and hold harmless BLUPEAK MEDIA LLC, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or connected with your access to or use of the services or your violation of these Terms.
These Terms shall be governed and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions.
Our services may contain links to third party websites or services that are not owned or controlled by BLUPEAK MEDIA LLC. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third party websites or services. We advise you to read the terms and privacy policies of any third party site you visit.
Any disputes arising out of or in connection with these Terms or the services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
BLUPEAK MEDIA Roofing Inquiry Messaging.
BLUPEAK MEDIA LLC sends SMS messages on behalf of the residential roofing contractors we serve. Messages are sent only to individuals who submitted an inquiry through a landing page BLUPEAK MEDIA operates on that contractor's domain and who explicitly opted in to receive SMS on that form. Each message identifies the roofing contractor you contacted and is marked "Powered by BLUPEAK MEDIA" to identify the sending party.
Messages include confirmation that your inquiry was received, scheduling of your free roof inspection or estimate, appointment confirmations and reminders, rescheduling updates, service related notifications, follow ups regarding your estimate, replies to questions you send us, requests to confirm a good time for a phone call, and promotional messages where you separately consented to receive those.
Opt in is collected on the inquiry form through two separate checkboxes, both unchecked by default. The first checkbox is required to submit the form and covers Customer Care messages. The second checkbox is optional and covers promotional messages. We do not enroll anyone by any other method, and we do not use purchased, rented, or acquired lists.
Consent to receive promotional SMS is not a condition of receiving an estimate, an inspection, or any other service.
You can cancel the SMS service at any time by texting STOP to the number that messaged you. After you send STOP, we will send a confirmation message and then stop sending SMS messages. To rejoin, submit a new inquiry and opt in again, and we will resume sending messages.

Carriers are not liable for delayed or undelivered messages.
Message and data rates may apply for messages sent to you from us and from you to us. Message frequency may vary based on your inquiry and appointment schedule. For questions about your text or data plan, contact your wireless provider.
Our SMS program works with all major U.S. wireless carriers, including AT&T, T-Mobile, and Verizon, and most regional carriers.
You must be 18 years or older to participate in our SMS program.
Mobile information, phone numbers, SMS consent, and text message opt-in data will not be sold, rented, leased, or shared with third parties, affiliates, or lead generators for marketing or promotional purposes at any time. This information is disclosed only to the roofing contractor whose landing page you submitted, so that contractor can provide the service you requested. We comply with all applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA) and CTIA Messaging Principles and Best Practices, regarding the use of SMS communications.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
